Peak Club Membership Terms & Conditions.

By submitting a membership application and/or registering as a Member of Peak Club, the Member acknowledges that they have read, understood, and agreed to be bound by the following Terms & Conditions, as amended from time to time by Peak Club.

1. Membership Eligibility

1.1 Membership is issued solely to the individual named in the application and, where applicable, to registered dependents under the approved membership category.

1.2 Peak Club reserves the right, at its sole discretion, to approve, decline, suspend, revoke, or terminate any membership application or membership account where deemed necessary.

2. Membership Transferability

2.1 Memberships are strictly personal and non-transferable.

2.2 Memberships may not be sold, assigned, shared, loaned, gifted, or otherwise transferred to any other individual, family member, friend, employee, company, or third party without the prior written consent of Peak Club Management.

2.3 Any unauthorised use, sharing, or transfer of membership privileges may result in the immediate suspension or termination of membership without entitlement to any refund, credit, or compensation.

3. Membership Fees and Refund Policy

3.1 All membership fees, joining fees, administration fees, and any other charges paid to Peak Club are strictly non-refundable.

3.2 Memberships are non-transferable and non-refundable regardless of whether the membership has been utilised, partially utilised, or remains unused.

3.3 No refund, whether in full or in part, shall be granted under any circumstances, including but not limited to:

• Non-utilisation of membership privileges;

• Change of mind;

• Relocation;

• Medical conditions or health-related reasons;

• Personal, financial, or employment circumstances;

• Early resignation, cancellation, or termination initiated by the Member; or

• Inability to utilise Club facilities or services.

3.4 Members remain responsible for all fees and obligations associated with their selected membership plan throughout the committed membership term.

4. Member Conduct

4.1 Members, dependents, and guests are expected to conduct themselves in a respectful, responsible, and courteous manner at all times while on Club premises or participating in Club activities.

4.2 Members shall comply with all Club rules, policies, procedures, safety requirements, and reasonable instructions issued by Club employees or authorized representatives.

4.3 Members are responsible for the conduct and behaviour of their dependents, family members, and guests while using Club facilities.

4.4 Bullying, harassment, intimidation, discrimination, abusive language, threatening behaviour, physical altercations, vandalism, theft, misconduct, or any behaviour that may negatively impact the safety, comfort, wellbeing, or enjoyment of other members, guests, or employees shall not be tolerated.

4.5 Peak Club reserves the right to suspend or terminate any membership for inappropriate behaviour or breach of these Terms & Conditions, in accordance with the Club's disciplinary procedures and management discretion.

5. Suspension & Termination of Membership

5.1 Peak Club reserves the right to issue a warning, suspend, restrict access to facilities, or terminate any membership where a member, dependent, guest, or associated individual:

a) Breaches these Terms & Conditions or Club policies;

b) Engages in inappropriate, disruptive, abusive, threatening, offensive, or unsafe behaviour;

c) Harasses, bullies, intimidates, or causes harm to another member, guest, visitor, or employee;

d) Damages, misuses, or intentionally interferes with Club property or operations;

e) Misuses membership privileges or provides false or misleading information;

f) Engages in any conduct deemed detrimental to the safety, wellbeing, reputation, interests, security, or operations of Peak Club.

5.2 Peak Club reserves the right to issue a warning, suspend, restrict access to facilities, or terminate any membership where a member, dependent, or guest engages in inappropriate behaviour, misconduct, harassment, bullying, unsafe conduct, or any action deemed detrimental to the safety, wellbeing, reputation, or operations of the Club.

5.3 Peak Club reserves the right to immediately suspend access to Club facilities while an investigation is being conducted.

5.4 The severity, frequency, and circumstances of the conduct, together with any available evidence, shall be considered when determining whether a warning, suspension, restriction of access, or termination is appropriate.

5.5 Membership fees shall remain non-refundable where a membership is suspended or terminated as a result of misconduct or a breach of these Terms & Conditions.

5.6 Peak Club's decision regarding disciplinary action, suspension, restriction of access, or termination shall be final and binding.

6. Guests & Family Membership Usage

6.1 Family memberships are intended solely for the registered individuals listed under the membership account.

6.2 Friends, employees, colleagues, or any other unregistered individuals are not permitted to utilize membership privileges unless expressly permitted under the membership category or approved by Management.

6.3 Members remain fully responsible for the conduct and actions of their guests while on Club premises.

7. Club Rules, Facilities & Liability

7.1 Members agree to comply with all facility-specific rules, safety requirements, booking policies, and operational procedures implemented by Peak Club.

7.2 Parents and guardians are solely responsible for supervising their children at all times while using Club facilities.

7.3 Use of Club facilities is at the Member's own risk. Peak Club shall not be liable for any loss, theft, or damage to personal belongings unless caused by proven negligence on the part of the Club.

8. Amendments & Management Rights

8.1 Peak Club reserves the right to amend, modify, or update these Terms & Conditions, Club rules, membership categories, operating hours, facilities, fees, and policies at any time without prior notice.

8.2 Continued use of Club facilities following any amendment shall constitute acceptance of the revised Terms & Conditions.

8.3 Peak Club reserves the right to suspend or terminate any membership for inappropriate behaviour, misconduct, or breaches of these Terms & Conditions where Management determines such action is necessary to protect the interests, reputation, safety, security, or operations of the Club.
